Emmident Shipping Costs
- Emmident Product orders 500gm and under, delivery cost within Australia is $9.90 (incl GST).
- Emmident Product orders over 500gm but under 1kg, delivery cost within Australia is $18.00 (incl GST).
- For deliveries outside Australia or if your delivery within Australia is 1kg or above, you will be charged $18.00 postal charges but will be contacted by Emmident Australia for any additional delivery charges.
1. Contract Contents
- Orders may be placed in writing, by fax, via e-mail or via internet. Acceptance of the order is acknowledged by dispatch of the goods by Emmident Australia. After the order has been processed, a cancellation can only be accepted within the definition of 8 “Exchange of Goods”.
- The goods register and price list of the Emmident Australia catalogue are subject to alterations. The Emmident Australia terms and prices valid at the time of the order being placed are decisive. (Should through no fault of Emmident Australia delivery takes place later than four (4) months following placement of the order, the prices valid at the date of delivery will be applied.) Mistakes and printer’s errors are non-binding.
- Due to legal restrictions, not all the offered products can be made available to all countries. Emmident Australia will keep customers well informed of this.
- The prices on the website are net prices and include the GST.
- Price increases for individual components of alloys e.g. cobalt, may result in price adjustments.
2. Delivery
- Delivery of goods is effected from Emmident Australia headquarters. Partial deliveries can be effected and charged. Additional transportation costs for partial deliveries will be added. However, the calculation of delivery costs is based on the weight of the order and on the mode of transport.
- For deliveries abroad all shipment costs are charged.
- Possible transport damages have to be reported to Emmident Australia as soon as discovered.
- Should the punctual delivery of goods be hindered due to reasons for which the customer is responsible, Emmident Australia will not be held responsible.
3. Extension of Delivery Period
- In case of an Act of God, industrial conflict actions, official measures and any other disruption of operations arising through no fault of Emmident Australia and which last or are expected to last longer than one week, the dispatch deadline will be appropriately extended for the duration of the hindrance.
- In the event of an occurrence of point 1 the counter-party has the right of withdrawal as long as notification of such is given by registered letter, email or fax at least two weeks in advance.
- Compensation claims will not be accepted in the aforementioned cases.
4. Payment
- The invoice will be drawn up on the day of delivery or availability of the goods.
- Emmident Australia expects payment in advance. (Arising bank charges will be charged to our customers.) Payment by credit card (VISA, MASTER and PAY PAL) is possible. Cheque payment is accepted but cheques must be cleared before delivery. Payment within 30 days is only granted after consultation with Emmident Australia.
5. Delay in Payment
- 6 % interest rate will be charged on overdue accounts. This will only come into effect once two reminder letters have been issued. Unless payment of the due invoice amount including interests of defaulted payment is effected, Emmident Australia is not obliged to fulfill further deliveries or can demand cash in advance of future orders.
- If one invoice amount is in delay all other invoices immediately become due.
6. Setting off of Payment/Credit Note
- The setting off of payment is only permissible in the case of undisputed claims which have been established as being legally valid. This does not apply where suspension of payment is put into effect by Emmident Australia.
- In all cases, credit amounts will be taken into account with the next invoice.
7. Notice of Defects
- 1. Complaints must be made in writing, telephone, E-mail or Fax. Notification of such must be made to Emmident Australia within a maximum of one (1) month following receipt of the goods.
- No complaints will be accepted once processing of the delivered goods has been commenced.
- Customary trade deviations or slight, technically unavoidable deviations do not qualify as defects.
- In the case of justifiable complaints, Emmident Australia retains the right to correct such or to deliver functional replacement goods within 6 weeks of receipt of the returned goods. After this period, the statutory regulations come into effect.
8. Exchange of Goods
- The reason for return must be given in writing to Emmident Australia. No credits will be given by Emmident Australia for goods which have not reached Emmident Australia.
- Intact and unopened material will only be exchanged by Emmident Australia within 14 days after receipt of goods on request of the customer.
- Appliances which have been in use or of which the packaging is damaged, are generally excluded from exchange.
- In all cases the costs of returning the goods will be carried by the customer, whereby Emmident Australia retains the right to raise an extra charge for processing costs.
- Special orders and custom products are excluded from exchange.
9. Customer Service
- Emmident Australia repairs all units from their own delivery program.
- Faulty appliances have to be sent back to Emmident Australia for verification and repair. All costs will have to be charged to the customer except in an event of warranty.
10. Retention of Ownership
- The delivered goods (goods of retention) remain the property of Emmident Australia until all demands arising out of the business relationship with the customer have been completely fulfilled.
- The customer is authorized to re-sell or dispose otherwise of his goods as long as the customer is not in arrears with his obligations due to Emmident Australia. To pledge goods of retention or to transfer ownership of securities for such goods to a third party is excluded. In the case of legal seizure of goods, the customer must explicitly draw attention to the retention of ownership and immediately inform Emmident Australia.
11. Place of Jurisdiction
The place of jurisdiction for all obligations under the Contract of Delivery is the Emmident Australia headquarters, Perth, Western Australia.
12. Legal Domicile
The legal domicile (also for legal actions concerning bills of exchange and cheques) is
Emmident Australia headquarters, Perth, Western Australia.
13. International Business
For international business the following additional terms apply:
- Every business including cheque payment and bill business is subject to the Australian civil and commercial law.
- Services in an event making a guaranty operative are only granted after consultation with Emmident Australia.
- Incurring clearance costs have to be paid by the customer.
- All banking charges are to be borne by the customer. They depend on the value of goods.
- Goods will only be shipped to the customer once the payment has been cleared by Emmident Australia’s financial institution.
15. Effectiveness of the Clause
Should individual clauses be or become ineffective or should the stipulation therein be incomplete, the legal effectiveness of the other clauses remain unaffected by this fact. An effective clause is agreed on as being valid in place of an ineffective clause, when the former achieves an economical result as close as possible to that desired under the original clause; the same applies in the case of an incomplete clause.
16. Important
Copying of our website in any form or extent is forbidden. Moreover, other mail order companies are not permitted to operate with this website. Printing errors and mistakes are non-binding.
Transport-related damages:
- Leave the unused merchandise in the packaging.
- Report the damage to the carrier immediately.
- Call Emmident Australia and report the incident.
- Do not, under any circumstances, send back damaged merchandise before you have contacted Emmident Australia.
Reclamation-Returns:
- If you return merchandise without calling Emmident Australia, it may result in unnecessary costs for you. To ensure this does not happen simply call us.
- Please attach the waybill/return slip with a description of why you are returning the merchandise in writing. If you fail to do this then you will be responsible for any costs, which occur due to the missing documents.
- It is not always necessary to return the merchandise. When possible we can send you replacement parts.
- When making a guarantee claim it is necessary to save the proof of purchase with date of purchase from Emmident Australia Pty Ltd.
